Determining the Nature of the Gold
The first stage of the customs clearance process is to correctly identify the gold to be imported or exported. Gold products may generally be classified under different categories, such as standard unprocessed gold, non-standard unprocessed gold, processed gold, jewellery, scrap gold, doré bars, granules, powder, or industrial raw materials.
Whether the gold is in the form of bullion, bars, granules, jewellery, semi-finished products, or scrap may affect the applicable Customs Tariff Statistics Position, required documentation, and relevant inspections. For example, standard unprocessed gold and gold classified as jewellery are not subject to the same customs procedures. Therefore, the technical characteristics and purity level of the goods must be accurately determined before the procedures begin.
Under Borsa Istanbul regulations, non-standard unprocessed gold is defined as gold in the form of bullion, bars, doré bars, granules, powder, or scrap that falls below the specified standard purity level.
Documents Required for Gold Imports
Depending on the nature of the transaction, the following documents may be required: a commercial invoice, transport document, packing list, certificate of origin, insurance certificate, proof of payment, assay or analysis report, and any notification or permit documents requested by the relevant authorities.
The declared quantity, weight, purity level, value, origin, and intended use of the gold must be consistent with the supporting documentation. Missing documents or discrepancies between the information provided may result in additional inspections, laboratory analysis, customs valuation investigations, administrative sanctions, or delays in the release of the goods from customs.
For imports of standard or non-standard unprocessed precious metals, additional obligations may apply depending on the status of the importer and the purpose of the import. These may include notification to Borsa Istanbul, submission of an assay report, an import declaration form, or similar requirements.
Since periodic quotas and notification requirements may also be introduced for imports of unprocessed gold, it is important to check the current regulations before each transaction.
The Importance of an Accurate Customs Declaration
In gold customs clearance procedures, the type, quantity, and value of the goods must be declared accurately and truthfully. Declaring gold at an artificially low value, classifying it under an incorrect Customs Tariff Statistics Position, or presenting commercial goods as personal belongings may constitute a violation of the applicable legislation.
Although the import and export of gold may generally be permitted within the scope of free trade, this does not mean that such transactions may be carried out without documentation or notification. In precious metals trading, customs, foreign exchange, tax, payment, record-keeping, and responsible supply chain requirements must all be complied with.
